Here's my problem.
I would like to send an Html christmas card to the registered members of my own forum but I am unsure where I stand as far as Anti-Spam legislation is concerned.
The site is hosted in the USA, is registered as non-profit .org but is amdinistered from the UK. Would the UK or USA laws apply ?

Also, I do not include express permission in my TOS to send emails to the membership. The registration process only requires the use of a genuine email address to send the password and username to. Would I be breaking the law if I sent out a "Merry Christmas to all members" type email?

I would love to say no but I bet you will anger someone who is Jewish, Muslim, or some other religion. Takes so little to bugger people these days and tolerance seems to be out the window. Better to just do a posting in the forums or add a graphic to your forums header.

If they got really upset and wanted to take down your site - US laws would apply.

If they sued you for some reason because of the content of the email - UK Laws would apply.
