I know i have been doing a lot of post about Avatars but i am so proud of mine and i have a lot to say.
I recently spoke to my uncle who majored in copyright law and he told me about my avatar. I got it off of a website i found through a google image search then i flipped it and resized it. He told me i should be okay becuase i flipped it and that was a change so i can't be sued for it. Just in case he told me to add a small change to it in order to ensure my legal stand point. All i did was change a white pixel to yellow.
The reason i'm posting this is, i suggest to everyone who has just found thier avatar(s) to add a small change in order to keep them safe.

I do not know for sure. One of the great things about America is the room for incredible interpertation of the laws. Which means it make be possible to try but the publishers (who technially own the copyright) will take you to court and the judge would almost definitly rule in thier favor.
I will ask my unlce when i talk to him agian

It is an interesting point that you bring up. Luckily, my pictures are of my own garden so I am the legal copyright owner and have nothing to worry about other than whether I will sue people who use my pics without asking me or getting permission.

Technically, the guy who invented the Smiley Face in the 70s owns the copyright. You are ripping off the website, who is ripping off him. Small changes mean nothing. In fact, any work *derived* from someone's copyrighted image can still fall under their copyright. Say I took a picture of Mickey Mouse, inverted the colours, flipped him upside down, applied a dozen Photoshop filters, and the printed it off on iron on transfers and made some t-shirts. Disney could still make a case against me. On the plus side, it's just an avatar and you aren't making money or defaming the original owner, so you should be ok, because it wouldn't be worth the hassle to file a suit against you. Also, my Photoshop Challenges are protected by Parody.

So under the parody loopholes, I could take Mike's avatar pic above and make changes to it (like inverting the letters or transposing them to Pus?), and use the pic w/o a problem, right? Cause I have this other account on the forum I haven't used that I need an avatar for...maybe I will power up my Photoshop and see what I can cook up with it.

Sorry guys, but Mike is correct. Under copyright laws, you really can't change it even a little. Here's the gov's info on this (scroll down to #5) ... http://www.copyright.gov/help/faq/faq-fairuse.htmlJustin - I'm very surprised that your uncle who is majoring in copyright law would give you such info, because it's been known to be a myth regarding changing the artwork to avoid copyright infringement. Any changes to the original copyright material would be considered a "derivative work," but even then a derivative must have the authorization/consent of the original work's copyright owner. Anyway, anyone wanting to use works by others should always do their due diligence and educate themselves with the copyright laws before doing so. The above link I gave you is where you can get all your info.

Yeah, I was going to ask leighsww how her vacation went, but then I wondered if she is actually back from vacation yet. Addendum: I also wonder if she will be shocked by the exploding number of polls in her absence, like insanity and chaos were unleashed while she was away (as well as an astonomical amount of addendums).

Hey, I'm not that addicted, like some others I know of without a life (they know who they are) that I would need to search out an Internet Cafe (besides, my husband tied me up and wouldn't let me). Good to be back, although I'm ready for another vacation from my vacation. Got some catching up to do on this forum I can see. I saw some WWW III stuff going on with Justin and Mike. Gosh, being gone one week can mean the end the world, huh? Well, I'll go read up on some of the other threads and see what I've missed (or should I say, "glad what I missed" from the "poll" threads going on) *edited - Hey, Miraenda - I can see those lightning fast fingers of yours hasn't missed a beat since I've been gone. I was responding to Ed's post when I hit the submit and there you were in front of me! You're just too fast for us!! You even had time for that "addendum"
