This is a weird one, because the copyright should be held by the photographer, but anyone who is recognisable within the photo must consent to it use if I understand the details right - model's contract or something  Thumbs Up

So there are several people who could get some suits going on and make some money from this exploit!

Well, couldn't they sue for it being posted on his site then without their permission? I don't actually intend to use it. I just wanted to worry Jwink a little that I would do something with it. I only use moderator's pics that I have crushes on, see.

Justin said that his avatar was OK because he changed it a bit. So, Miraenda, we can change Justin's blue hair pic (just "a bit"  :twisted: ) and say it's ours.  Cool

No because it is an actual person, the only way you could use it would be to make all the people unrecognisable... That means if they can look at just the image of themself without the background and say - 'Hey that's me', you can't use it  Confused

yes it is but i made changes to it to the point that the other source cannot really claim ownership. I do not know how legal that makes my avatar but it is closer. Plus this smily face is all over the world.

Your above post is still far from legal. Id i take one of your flower photos and crop off three pixels, it is still yours. One nice thing about the USA legal system is it subjectivity (which can be bad aswell). If i can prove to a judge that that was part of my original photo then i win the case. now for educational purposes it is totally different. I could photocopy a certain % (do not know what it is) from a book if i were a teacher and wanted to teach from the book. That does not mean you could use my photos to teach people here. It has to be in a legitamate school

Also, I don't intend to use it. If I did, I would have done so by now. Don't worry. On the other hand, you can use my pics all you want to do so. I don't even hotlink protect them.
